US Judge Mandates Freedom of Abrego Garcia from ICE Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.
The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling charges, he was detained in federal detention.
In her decision, the court noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
Context of the Case
The legal proceedings center on disputed claims. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in the state of Tennessee.
Conditions of Release
The court, who was hearing his petition to deportation in a federal court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
This ruling marks a significant development in a complicated immigration case featuring claims of mistaken imprisonment and disputed criminal affiliations.
